Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of Traccia (traccia.ai), including the website, application, APIs, and related services (the "Service"). The Service is operated by Algen AI Private Limited ("Algen," "we," "us"), registered in India (CIN U62020KA2026PTC215610), with registered office at WeWork Roshni Tech Hub, Marathahalli / EPIP Zone, Bengaluru, Karnataka 560037, India.

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Traccia provides observability, evaluation, and governance tooling for AI agents and related workloads. Features, plans, and limits may change over time. Optional compliance modules (for example EU AI Act or HIPAA-oriented workflows) are tools to help you collect evidence; they do not constitute legal advice, certification, or a guarantee of regulatory compliance. 3. Accounts and eligibility

  • You must provide accurate registration information and keep it updated.
  • You are responsible for activity under your account and for safeguarding credentials and API keys.
  • You must be able to form a binding contract under applicable law.
  • Organization administrators are responsible for managing members, workspaces, and billing for their organization.

4. Acceptable use

You agree not to:

  • Use the Service to violate law or third-party rights
  • Attempt unauthorized access to the Service or other customers' data
  • Interfere with or disrupt the Service, including abuse of rate limits or infrastructure
  • Reverse engineer the Service except to the extent permitted by law
  • Misrepresent your identity or affiliation
  • Upload malware or content that is unlawful or infringing

We may suspend or terminate access for violations or to protect the Service and other users.

5. Customer content

You retain ownership of data you submit to the Service ("Customer Content"), including telemetry and prompts. You grant us a limited license to host, process, and display Customer Content solely to provide and improve the Service as configured by you. You represent that you have the rights necessary to submit Customer Content.

6. Intellectual property

The Service, including software, documentation, branding, and our websites, is owned by Algen AI Private Limited or its licensors. These Terms do not grant you any right to use our trademarks except as needed to identify the Service. Open-source SDK components are licensed under their respective open-source licenses.

7. Fees and plans

Paid plans, usage-based charges, and free tiers are described on our Pricing page or in a separate order form. Fees are non-refundable except where required by law or expressly stated otherwise. We may change prices with notice for renewals as permitted by your plan terms.

8. Third-party services

The Service may interoperate with third-party platforms (for example LLM providers, OAuth identity providers, and cloud infrastructure). Your use of those services is governed by their terms. We are not responsible for third-party services we do not control.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL MEET YOUR COMPLIANCE OR CERTIFICATION REQUIREMENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALGEN AI PRIVATE LIMITED AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF YOU USE ONLY A FREE TIER, ONE HUNDRED US DOLLARS OR EQUIVALENT).

11. Indemnity

You will defend and indemnify Algen AI Private Limited against claims arising from your Customer Content, your misuse of the Service, or your violation of these Terms or applicable law, to the extent permitted by law.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk to the Service, non-payment, or as required by law. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.

13. Governing law

These Terms are governed by the laws of India. Subject to mandatory consumer protections that may apply in your jurisdiction, courts in Bengaluru, Karnataka, India will have exclusive jurisdiction over disputes arising from these Terms or the Service.

14. Changes

We may update these Terms by posting a revised version on this page with an updated "Last updated" date. Continued use after the effective date constitutes acceptance of the revised Terms, except where additional consent is required by law.
